In 2020, Broomhead & Saul (working in collaboration with its commercial associate Solicitors Title LLP) transformed the way Wills are prepared and executed in England & Wales.
Our ground-breaking research and our product development, in combination with highly successful snap reform campaign, persuaded the government to pass emergency legislation sanctioning our precedent setting practice of video witnessing of Wills using video conferencing. It was necessary to overcome the legal profession’s uniform hostility to innovation in this area of practice and in doing so we brought about the most significant change to Will writing services since 1677.
Going the extra mile
This reform resulted from our determination to help a self-isolating client execute his will during the first Covid-19 lockdown. Our ground breaking research revealed that the formalities of the Wills Act 1837 were compatible with modern technology, notwithstanding the views of the Law Commission to the contrary, which we discovered to be based on flawed research.
We executed the nation’s first remotely witnessed Will on 1 May 2020 and on 25 July we executed the first cross border video witnessed Will for an expat lady living in Crete in which she arranged for the deposition of her English Estate. We act for clients in Europe and America. Our latest cross border Will and estate planning instructions came from clients who are now domiciled in Florida.
The government’s emergency legislation, The Wills Act Amendment Order 1837, is highly unusual in the way that it validates our approach with retrospective effect backdated to 31 January 2020.
