In 2020 we made legal history at our Taunton office during the first national lockdown by using video conferencing technology to witness the execution of a Will for a self-isolating client. This controversial innovation defied the official guidance that adhered to the misconceived opinion expressed in the Law Commission’s Making A Will report that claimed that the Will making formalities prescribed by the Wills Act 1837 insist on a witness’ physical presence. Our ground-breaking and controversial research that established that video witnessing was consistent with the legislation and the common law rulings interpreting it and our novel protocols and procedures demonstrated that video witnessing could enhance the Wills Act’s anti-fraud objectives . We initiated our own snap campaign that persuaded the Government to pass emergency legislation sanctioning our innovative procedures, retrospectively.
